The owner of the Anuait Online Store (hereinafter the Webstore) is Anu Ait OÜ (registry code 10566843), located at Betooni 2a, 51014 Tartu.
Anu Ait OÜ products can be purchased in two ways, by ordering online or at the sales point.
- Validity of the sales contract, commodity and price information
1.1 The Terms of Sale apply to the purchase of goods from the Webstore.
1.2 The prices of the products sold in the Webstore are given together with the products. The prices quoted in the Webstore are in euros and include VAT. The seller has the right to change the prices unilaterally.
1.3 Delivery fee is added to the price.
1.4 The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee will be shown to the buyer when placing an order.
1.5 Information about the goods is provided in the Webstore at the goods.
1.6 The pictures attached to the Product are of illustrative purpose.
2 Placing an Order
2.1 To order the goods you need to add the desired products to the shopping cart.
2.2 To complete the order, fill in the required fields and select the desirable delivery method. Then the total amount of the payment will be displayed, payable via bank link or other payment method.
2.3 The Agreement will enter into force upon receipt of the amount due into the bank account of Webstore.
2.4 If the ordered goods cannot be delivered because they are sold out or for any other reason, the Buyer shall be informed as soon as possible. In this case, any money paid (including delivery charges) will be refunded immediately, but no later than 14 days after the notice has been received. Alternatively, an equivalent product will be offered.
3.1 The goods will be shipped to the following countries: Estonia.
3.2 The shipping cost of the goods is borne by the Buyer and the corresponding price information is displayed next to the shipping method.
3.3 Shipments within Estonia generally arrive at the destination specified by the buyer within 3-7 business days after the contract of sale has entered into force.
3.4 The Webstore shall not be liable for any delay of the delivery of the Goods if the Goods have been passed over to the Logistics Partners in due time and the delay in delivery is due to circumstances beyond the Webstore’s control or foreseeability.
4 Right of withdrawal
4.1 After receipt of the order, the Buyer shall have the right to withdraw from the contract concluded in the Webstore within 14 days
4.2 The right of withdrawal does not apply if the buyer is a legal person.
4.3 To exercise the 14-day right of return, the returned goods must be intact, unopened in their original packaging and undamaged.
4.4 If the goods show signs of use or wear, the Webstore has the right to refuse from accepting the return of goods.
4.5 In order to return the goods, a written application for withdrawal must be submitted and sent to the email address email@example.com within 14 days of receipt of the goods.
4.6 The cost of returning the Goods shall be borne by the Buyer unless the reason for the return is that the Goods to be returned are not in conformity with the order (e.g. faulty or defective Goods).
4.7 The Buyer must return the goods within 14 days following the submission of the application or to provide proof that he has passed the goods to the forwarder within the said period.
4.8 Upon receipt of the returned goods, the Webstore shall refund the Buyer any sums received from the Buyuer under the Agreement without delay, but no later than 14 days after the receipt of the withdrawal request.
4.9 The Webstore may refuse to refund the goods to be returned until the goods specified in the contract are returned or the Buyer has provided proof that goods were returned.
4.10 The Webstore has the right to withdraw from the sale contract and reclaim the Goods from the Buyer if, by mistake, the price of the Goods in the Webstore is significantly lower than the market price of the Goods.
5 Right to submit a claim
5.1 The Webstore shall be liable for any lack of conformity or defect in the goods sold to the Buyer that the Goods already had at the time of delivery. It is the Webstore’s responsibility to disclaim it.
5.2 The Buyer shall have the right to contact the Webstore within two months at the latest by sending an e-mail to firstname.lastname@example.org.
5.3 The Webstore shall not be liable for defects which have arisen after delivery of the goods to the Buyer.
5.4 If the goods purchased from the Webstore have defects for which the Webstore is responsible, the Webstore shall replace the defective goods. If it is not possible to replace the goods, the Webstore shall refund the Buyer all the sums related to the contract of sale.
5.5 The Webstore shall respond to the consumer’s complaint in writing or in a format which can be reproduced in writing within 15 days.
6.1 The Webstore and the Buyer shall be liable for damages to the other Party when violating these Terms and Conditions and to the extent provided by the legislation of the Republic of Estonia.
6.2 No liability shall be taken for damages arising from non-functional or improper use.
7 Force majeure
7.1 The Webstore shall not be liable for any damage or delay in the delivery of goods, if the loss or delay in delivery is due to circumstances beyond the seller’s control or foreseeability.
8 Direct marketing and processing of personal data
8.1 The Webstore shall use the personal data entered by the Buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and delivering the goods to the Buyer.
8.2 The Webstore provides the forwarder with personal information for delivering the goods.
8.3 The Webstore will only send newsletters and offers to the Buyer’s email address if the Buyer has requested to do so by entering an email address on the Website and announcing their wish to receive direct mail notifications.
8.4 The Buyer may at any time unsubscribe from offers and newsletters sending an email to Webstore or by following the instructions in the e-mails.
9.1 If the Buyer has any claims against the Webstore, they have to be sent by email to email@example.com
9.2 The Buyer is entitled to contact the European Union Consumer Dispute Resolution Platform, if needed.
